1. The revisional application has been preferred praying for quashing of the proceedings in Singur P.S. Case No. 426 dated 30.09.2022 under Sections 341/323/384/504/506/120B of the Indian Penal Code, arising out of G.R. Case No. 1642 of 2022, pending before the learned Additional Chief Judicial Magistrate, Hooghly at Chandannagore.
2. The petitioners herein submit that the complaint in the present case is a fall out of a complaint lodged by the wife of the de facto complainant in the present case, under Sections 498A/406 and 3 and 4 of the Dowry Prohibition Act.
3. Learned counsel for the State is present with the case diary.
4. Considering the materials on record and on perusal of the written complaint in the present case which is dated 30.07.2022, this Court finds that admittedly there is a
2 matrimonial dispute between the parties and both parties have grievance against each other and also allegations against each other.
5. Accordingly, the writ application is disposed of with the direction that the learned trial Court, Additional Chief Judicial Magistrate, Chandannagar, Hooghly, shall refer the parties in the present case, who are also the parties in the proceeding under Sections 498A/406 and 3 and 4 Dowry Prohibition Act, for mediation before the concerned Legal Services Authority and all efforts be made to amicably settle the dispute between the parties, by the Court.
6. Pending mediation, the proceeding in the present case be stayed till disposal of the mediation, which be completed by the 30th November, 2026.
7. Petitioner shall be at liberty to pray for necessary reliefs before appropriate forum, in case the mediation fails.
8. The revisional application is disposed of.
