20.08.2026 Sl. No.12 AMR Ct.No.655 CRA 60 of 2008 In the matter of : Razzak Gazi .... Appellant Mr. Lokesh Sharma …for the State 1. None appears on behalf of the appellant. 2. In compliance with the direction passed by this Court earlier on 12.12.2025, a report is submitted by the Superintendent, Baruipur Central Correctional Home, indicating that the appellant/convict, Razzak Gazi, had already completed his sentence period w.e.f. 07.04.2005 to 06.04.2012 for seven (7) years on 06.04.2012 including UT set off period from 07.05.2025 to 11.09.2025. 3. As the appellant/convict did not pay his fine of Rs. 50,000/-, which was imposed to him by the learned Trial Court in the impugned judgment and order of conviction, he suffered one year more rigorous imprisonment w.e.f. 07.04.2012 to 06.04.2013 as fine sentence. The said report further indicates that the appellant/convict, Razzak Gazi, was released from the erstwhile Alipore Central Correctional Home after suffering total imprisonment of eight (8) years on 06.04.2013. 2 4. Considering the situation, the appellant/convict had already served the substantive sentence, as passed by the learned Trial Court in the impugned judgment and order of conviction, the present appeal becomes infructuous. 5. The instant appeal is hereby dismissed as infructuous. 6. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately. 7. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
