Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 2 years but till date there has been no progress of the case. Only the examination of few witnesses have been conducted and the prosecution intend to examine 15 witnesses in support of its case.
Learned advocate for the State has produced the case diary, referred to the medical documents as well as the statement of the victim under Section 183 of the BNSS.
Having considered the materials appearing against the present petitioner, I am of the view that, prima facie, offence
2 has been made out. The report reflects that charge was framed on 28.06.2024. Examination of two of the witnesses were in progress.
Having considered the incriminating materials appearing against the petitioner, prima facie, I am of the opinion that this is not a fit case for granting bail.
Accordingly, prayer for bail of the petitioner in CRM (M) 781 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
