An affidavit of service is also tendered across the Bar and is taken on record. In that view of the matter, the matter is heard. The present application is filed seeking transfer of the proceedings from Amravati to Darwha. 2. As can be seen from the memo of the application, the applicant and non-applicant, being husband and wife, there were certain marital discord,which prompted the non-applicant to file an application for divorce before the Family Court at Amravati. Thereafter, the applicant-wife also filed an application under the Domestic Violence Act, and the same is pending before the competent Court at Darwha. It is also submitted that a petition filed under Section 9 of the Hindu Marriage Act, 1955, is also pending before the Civil Court, Senior Division, Darwha. It is submitted that the applicant, being the wife, has a two-year-old child and, considering the distance of about 90 km between Darwha and Amravati, it is inconvenient for her to travel on each and every date. It is, therefore, Shubham 2026:BHC-NAG:11047 (2) 37.MCA(Tr.)185.26 prayed that the proceedings at Amravati be transferred to the Court at Darwha. 3. In that view of the matter, the application is allowed. The Marriage Petition No. A-282/2024, filed by the non-applicant under the provisions of the Hindu Marriage Act seeking divorce and pending before the Family Court, Amravati, is transferred to the Court of the Civil Judge, Senior Division, Darwha. 4.
