JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. The grievance of the petitioner is directed towards the impugned endorsement of Annexure-A dated 06.02.2025 issued by respondent No.3 - Assistant Director of Land Records, Yelahanka Taluk, declining to conduct the survey and Haddubasthu on the ground that there are civil litigations in O.S.No.1453/2023, O.S.No.645/2024, O.S.No.2186/2023 and O.S.No.2185/2023 and there were interim orders passed by the Civil Court. Learned counsel for the petitioner however submits that O.S.No.1453/2023 concerns the subject matter of this writ petition and the other three suits do not pertain to the land in question. The learned counsel further submits that the petitioner has also filed O.S.No.645/2024 seeking permanent injunction and all the suits mentioned therein are pending consideration. 3. When admittedly there are disputes between the petitioner and the neighbours and two suits are pending - 4 - HC-KAR NC: 2026:KHC:11479 WP No. 5935 of 2025 consideration in respect of the lands in question, normally this Court would direct the Survey Settlement Authorities not to go ahead with the survey. On the other hand the parties can always make an application before the Civil Court seeking appointment of a Commissioner in the form of ADLR to survey the property. If need such an application can be considered by the Civil Court and pass necessary orders if the survey is required to be conducted. If the petitioner has already filed such an application, the Civil Court may proceed to consider such an application and pass necessary orders. Accordingly, writ petition stands disposed of.
