In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Gangarampur PS Cse No. 120 of 2026 dated 28.02.2026 u/s 21(c)/22(c)/23(c)/27A/28/29 of the NDPS Act [NDPS Case No. 13 of 2026].

In the matter of : Abdul Miah
… Petitioner(s)
Mr. Kaushik Choudhury Mr. Dwaipayan Panda
… for the petitioner(s)
Ms. Priti Kar Bagchi
… for the State-respondent(s)
Learned advocate for the petitioner submits that there has been change of circumstances as the earlier grounds which were shown by the State in the meantime do not exist. It is also submitted that the petitioner has been arrested in connection with another case presently. Having considered that the present case is under the provisions of the NDPS Act and there is another case against the present petitioner, I am of the view that this is not a fit case for granting anticipatory bail. Since none appears on behalf of the State, Ms. Priti Kar Bagchi, learned advocate, who ordinarily appears on
2 behalf of the State, is directed to represent the State. Her appearance may be regularized by the concerned authority. Hence, the prayer for anticipatory bail of the petitioner is Rejected. Accordingly, CRM (A) 1734 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
