The Court:- Affidavit of service filed today is taken on record. None appears on behalf of the State/respondents despite service. Mr. Deb Roy, Learned A.G.P who usually appears on behalf of the State is present in Court. Upon being requested to Mr. Deb Roy he assists this Court along with Mr. Bipin Ghosh, learned Advocate in this matter. The department of Legal Remembrance is requested to regularize his appearance in this matter. The petitioner in the instant case is a Stage Carriage Permit Holder who applied for curtailment of the route of a passenger bus which is now existing between Birpara to Islampore via Mai Bazar, P C Mittal Bus Terminus, Siliguri. The main grievance of the petitioner is that the said route alignment as mentioned in the permit is not financially viable since after Siliguri Bus stop

there are hardly any passengers to travel between Siliguri to Islampore. The distance between the stoppage is 78 kms and as such, the ‘to and fro’ journey of the bus results in a huge financial loss. The petitioner already made an application dated 25.06.2025 before the respondent no. 3 but the same remains pending for consideration. After hearing the parties at length and upon perusing the materials available on record, I am of the considered view that since the representation is pending for a considerable period of time, the respondent no. 2 shall consider the said representation within a period of 60 days after giving an opportunity of hearing to the petitioner and the other stake holders, if any, and pass a reasoned order in accordance with law. The said authority shall communicate the reasoned order upon the petitioner within two weeks thereafter. The writ petition is disposed of without going into the merits of the case.
