Heard the learned Counsel appearing for applicant Nos.1(A) to 1(C) and the learned A.G.P. for non-applicant No.2. 02. By the present application, the applicants/claimants seek withdrawal of the entire amount of compensation deposited by the appellant-acquiring body with the Registry of this Court, as per the order dated 01/08/2017. 03. Needless to say, the first appeal was directed against the judgment and award dated 12/01/2015 passed by the learned Joint Civil Judge, Senior Division, Nagpur in Land Acquisition Case No.257/2012. On 01/08/2017, this Court passed an order and directed the appellant- acquiring body to deposit the entire amount of compensation of Rs.61,07,894/- with the Registry of this Court. Accordingly, on 04/09/2017, the appellant-acquiring body deposited the said amount with the Registry of this Court. 04. In the past, the applicants/claimants had filed two civil applications bearing CAF No.3364/2017 and CAF No.3900/2018, seeking 2026:BHC-NAG:10995 901.caf.3318.26 2/2 permission to withdraw some portion of the compensation amount. Accordingly, on 22/05/2018 and 08/01/2019, the applicants withdrew an amount of Rs.20,00,000/- and Rs.25,00,000/-, respectively. On 16/07/2026, the first appeal came to be dismissed. Therefore, the present applicants are entitled to withdraw the remaining amount of compensation out of the entire compensation amount deposited by the appellant. 05. In view of the above, the civil application is allowed. The applicants/claimants are permitted to withdraw the remaining amount of compensation as per their respective shares, along with accrued interest thereon. 06. The Registry is hereby directed to issue the account payee cheque in favour of the applicants/claimants in their joint account maintained with the State Bank of India, Narkhed. 07.
