Learned advocate appearing for the petitioner submits that the petitioner is in custody for about eight months and the subject matter of recovery in the present case is 3150 bottles of codeine phosphate solution. According to the petitioner other accused persons are absconding, as such there is no possibility of the trial commencing very soon. Thus, the petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that huge/commercial quantity of contraband has been seized. I have taken into account the overall circumstances and is of the opinion that rigors of Section 37 of the NDPS Act is attracted. As such, prayer for bail of the petitioner is rejected at this stage. Learned trial Court would exhaust the process of law, split up the trial and take steps for overcoming the stage of consideration of charges at the earliest.
2 With the aforesaid observations CRM (NDPS) 1601 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
