In connection with Bamangola P.S case no. 110 of 2025 dated 30/06/2025 under Sections 25/29 of the NDPS Act. In the matter of: Nabi Saheb @ Rabikul Islam & Anr. ...Petitioners. Mr. K. Choudhury Mr. D. Panda …for the petitioner. Mr. Amal Kr. Datta Mr. Karan Dudhwewala …for the State. Learned advocate for the petitioners submits that the petitioners have been implicated on the basis of the statement of co-accused in respect of seizure of 200 bottles of codein phosphate. Learned advocate for the State submits that so far as the petitioner no. 1 is concerned, the same makes out a case on the foundation of the statement of the co-accused. However, so far as the petitioner no. 2 is concerned, there are call detail records available during the check period for which the offence is investigated. Having considered the overall circumstances, I am of the view that the prayer for anticipatory bail of the petitioner no. 1 (Nabi Saheb @ Rabikul Islam) is allowed and that of the petitioner no. 2 (Mursed Alam @ Muksed Alam) is rejected. 2 In the event of arrest, the petitioner no. 1 shall be released subject to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the charge sheet has already been submitted, this order of anticipatory bail in respect of petitioner no. 1 will remain in force for a period of six weeks. Accordingly, the application for anticipatory bail being CRM(A) 855 of 2026 is allowed-in-part. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
