IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 138 CR-5531-2026 Date of decision :22.07.2026 DHARMINDER SOOD AND ANOTHER ... PETITIONERS VERSUS NEERU SOOD AND ANOTHER ...RESPONDENTS CORAM: HON'BLE MR. JUSTICE PARMOD GOYAL Present: Mr. Prateek Pandit, Advocate for the petitioners. **** PARMOD GOYAL, J. (ORAL) 1. The present revision petition has been preferred by the petitioners under Article 227 of the Constitution of India for setting aside of the impugned order dated 09.06.2026 (Annexure P-9) passed by Additional District Judge, Kapurthala whereby ex parte order of status quo was passed in favour of the respondents, who are appellants before the Court of learned Additional District Judge, Kapurthala. 2. Learned counsel for the petitioners submits that the respondents during the summer vacation have succeeded in obtaining ex parte order whereby parties were directed to maintain status quo, by suppressing material facts and by making misleading representations before the Appellate Court. It is contended that the matter was pending before the Mediation Centre and was likely to be settled amicably. However, by virtue of the impugned ex parte order directing the parties to maintain status quo, the petitioners have been deprived even of the right to carry out necessary repairs and maintenance of the suit property, thereby causing undue hardship and prejudice to the petitioners. MANOJ KUMAR 2026.07.23 19:54 I attest to the accuracy and integrity of this document CR-5531-2026 -2- 3. In the present case, the learned Appellate Court has granted an order directing the parties to maintain status quo only to facilitate the mediation proceedings, so that neither party alters the nature or character of the suit property during the pendency of the mediation. This aspect has been specifically noticed by the learned First Appellate Court in its order dated 09.06.2026. 4. Moreover, the appropriate remedy available to the petitioners is to approach the learned Appellate Court and seek vacation of the ex parte order, rather than invoking the supervisory jurisdiction of this Court by filing the present revision petition. 5. Faced with the above, learned counsel for the petitioners submits that the petitioners may be relegated to the remedy of approaching the learned First Appellate Court for seeking vacation of the ex parte order of status quo. 6. In view of the statement made by learned counsel for the petitioners, the present revision petition is disposed of with liberty to the petitioners to approach the learned First Appellate Court and seek vacation of the ex parte order of status quo, in accordance with law. If such an application is filed, the learned First Appellate Court shall decide the same expeditiously, preferably within a period of two months from the date of its filing, after affording an opportunity of hearing to all the concerned parties. 7. Disposed of accordingly. 8. Pending miscellaneous application(s), if any, also stand(s) disposed of accordingly. 22.07.2026 (PARMOD GOYAL) manoj JUDGE Whether speaking/reasoned Yes Whether reportable Yes/No MANOJ KUMAR 2026.07.23 19:54 I attest to the accuracy and integrity of this document
