Heard the learned counsel for the petitioner and learned High Court Government Pleader for respondent No.1 / State. Respondent No.2, who is served in the matter, has remained unrepresented. 3. FIR in Crime No.51 of 2026 was registered by Jayanagar Police Station against petitioner and his mother, based on the first information dated 28.02.2026 received from respondent No.2, who is the mother of the victim girl aged 17 year 11 years. During the course of investigation of the case, the petitioner was arrested on 28.02.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed against two persons and petitioner is arrayed as accused No.1 in the charge sheet. His bail application filed before the Trial Court - 4 - HC-KAR CNR: KAHC010469342026 NC: 2026:KHC:43796 CRL.P No. 10200 of 2026 Crl.Misc.No.4556 of 2026 was rejected on 01.07.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that the petitioner and the victim girl were in love. In the month of September, 2025 victim girl had left her house and had gone with the petitioner. Thereafter, they got married in a temple at 5th block Jayanagar, Bengaluru and stayed together in the house of the petitioner. No complaint was filed by the relatives of the victim girl, after the petitioner had married the victim girl in the month of September, 2025. It appears that the victim girl had subsequently committed suicide in her matrimonial house on 28.02.2026 by hanging herself. 5. Perusal of the charge sheet would go to show that allegation of ill-treating the victim girl and instigating her to commit suicide is found in the charge sheet against accused No.2, who is the mother of the petitioner. Petitioner, aged 19 years is in custody in the present case for the last more than five months. Investigation of the case is now completed and charge sheet is filed. Continued detention of the petitioner in custody amongst hardened criminals is likely to have an adverse impact on him. 7. Considering the aforesaid aspect of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Spl.C.No.911 of 2026 pending before the Court of Fast Track Special Court-3, (FTSC-III) City Court Complex, Bengaluru City, arising out of Crime No.51 of 2026 registered by Jayanagar Police Station, Bengaluru City for the offences punishable under - 6 - HC-KAR CNR: KAHC010469342026 NC: 2026:KHC:43796 CRL.P No. 10200 of 2026 Section 137(2), 64(1), 108 of BNS, 2023 and Section 4 and 6 of POCSO Act, 2012 and Section 9 of Prohibition of Child Marriage Act, 2006, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without - 7 - HC-KAR CNR: KAHC010469342026 NC: 2026:KHC:43796 CRL.P No. 10200 of 2026 permission of the said Court until the case registered against him is disposed off.
