Hekamat Sardar & Ors. Vs. The State of West Bengal & Ors.
Mr. S. Nath Mr. Aktaruzzaman
…for the petitioners Mr. Anindya Basu Mr. Partha Sarathi Basu
…for the State
1. Matter is heard in presence of the learned advocates representing petitioners and State respondents.
2. On hearing learned advocates representing parties and perusing the writ petition it appears that prayer is made for issuance of mandamus directing the concerned police authority to take steps which would facilitate petitioners to have peaceful possession over the property in question.
3. It appears that issue involved in this writ petition is civil in nature requiring the petitioners to approach appropriate forum.
4. If petitioners find that right to enjoy peaceful possession over the property in question is
2 disturbed by private respondents petitioners need to approach Civil Court.
5. Hence, present writ petition is not interfered with and same stands dismissed.
6. However, this order shall not preclude the petitioners to take steps in accordance with law.
7. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
