1. Affidavit of service filed in Court today is taken on record. 2. The petitioner is the Teacher-in-Charge of a school. She has raised certain allegations against the private respondent no.16, who is an Assistant Teacher of the said school. 3. It appears that an enquiry was conducted on 5th November, 2024 and the enquiry report was forwarded by the District Inspector of Schools (SE), Kolkata to the Deputy Secretary (Disciplinary Proceeding), West Bengal Board of Secondary Education on 20th November, 2024. No steps have been taken thereafter. 4. Learned advocate representing the West Bengal Board of Secondary Education submits, upon
2 instruction that, copy of the enquiry report was not received by the Board. 5. Learned advocate representing the private respondent no.16 produces a copy of the charge-sheet issued by the Deputy Secretary (Disciplinary Authority) on 6th March, 2025 relying upon the report of the DI (SE), Kolkata dated 20th November, 2024. 6. It appears that a show cause notice was also issued to the private respondent no.16 on 8th January, 2025 and the response to the show cause being found to be unsatisfactory, a charge-sheet has been issued against the private respondent no.16. The charges levelled against the private respondent no.16 are as follows:
“1. That allegedly he has misbehaved and not cooperated with the present TIC. 2. That allegedly he has been irregular in his attendance and has availed leave without any intimation to the school authority. 3. That allegedly he has created an unhealthy situation in the school.”
7. The private respondent no.16 has been given a fortnight’s time to reply to the charges. 8. Upon perusal of the enquiry report, it appears that there are allegations and counter- allegations made by and between the parties. The disciplinary authority has already taken note of the report and has taken necessary steps in the matter. 9.
As it appears that the Board has already taken steps in response to the complaint lodged by the
3 petitioner, accordingly, no useful purpose will be served by keeping the writ petition pending. 10. The instant writ petition stands disposed of by directing the Deputy Secretary, being the Disciplinary Authority of the West Bengal Board of Secondary Education, to dispose of the proceeding initiated against the private respondent no.16 strictly in accordance with law at the earliest but positively within a period of three months from the date of communication of this order. 11. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 12. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities. (Amrita Sinha, J.)
