18.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.20 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (A) 1878 of 2026 In Re : An Application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Gangarampur Police Station Case No. 287 of 2025 dated 05.05.2025 under Sections 126(2)/117(2)/ 109(1)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (G.R. Case No. 587/2025). And In Re : Jhajho Urao @ Oraon and others ... Petitioners. Mr. Manas Kumar Das ... For the Petitioners. Ms. Hasi Saha, Mr. Saswata Chatterjee ... For the State. Learned advocate appearing for the petitioners submits that the present case was initiated as a counterblast to Gangarampur Police Station Case No. 251 of 2025 dated 21.04.2025. The said case was registered under Section 64(1) of BNS amongst other sections. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail. I have taken into account the injury reports also. Having considered the genesis of the present case and the fact that de facto complainant’s son is the accused in Gangarampur Police Station Case No. 251 of 2025 and the present petitioners are relations of the informant of the said case, I am of the opinion that custodial detention of the present petitioners in connection with the instant case is unwarranted as there was a justification in the incident. As 2 such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners viz., 1. Jhajho Urao @ Oraon, 2. Kamal Oraow @ Oraon, 3. Bappa Oraow @ Oraon and 4. Sujit Pahan shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Photostat copy of the First Information Report submitted by the learned advocate appearing for the petitioner be kept with the record. The application for anticipatory bail, being CRM (A) 1878 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
