And In the matter of : Arindam Mitra
……Petitioner. Mr. Kamalesh Jha Mr. Kausik Biswas Mr. Debojyoti De
.....for the Petitioner. Mr. Rajesh Kr. Shah
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is suffering from serious medical ailments and so far as the amount which is the subject matter of the present case, the same has already been refunded. Learned advocate appearing for the State opposes the prayer for bail. Record reflects that petitioner has 12 criminal antecedents relating to offences of cheating and forgery. Present is one wherein the cheques along with the document of RTGS were forged. Having considered the previous conduct of the present petitioner, the manner in which the present offence has been committed, at this stage, I am not inclined to release the petitioner on bail.
2 Accordingly, the prayer for bail of the petitioner in CRM (M) 1057 of 2026 is dismissed. So far as the issues relating to ailments are concerned, petitioner would be at liberty to take out an appropriate application before the learned Jurisdictional Court, learned Jurisdictional Court would assess the genuinity of the medical conditions and thereafter pass necessary directions for treatment of the present petitioner. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
