ORAL ORDER
The records, including the notice dated 05.11.2025 addressed on behalf of the petitioners to the respondent and the Joint Development Agreement/Supplementary Sharing Agreement, are perused. The petitioners have nominated a retired District Judge as their nominee arbitrator. The respondent has issued no reply, but learned counsel for the respondent submits that a retired District Judge other than the District Judge nominated by the petitioners could be appointed as the sole arbitrator.
On a careful consideration of all circumstances, this Court is of the considered opinion that Sri M. Ramesh Rao, a retired District Judge, must be appointed as the sole arbitrator to enter reference of the dispute in the arbitral proceedings leaving open all
contentions to be urged in such proceedings. Hence, the following.

ORDER [A] The petition is allowed. [B] Sri M. Ramesh Rao, a retired District Judge, is appointed as the sole Arbitrator to enter reference of the dispute between the petitioners and the respondent and conduct the proceeding at the Arbitration and Conciliation Centre (Domestic and International), Bengaluru according to the Rules governing the Centre. All questions are left open for due consideration. [C] The Registry is directed to communicate this
