The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit no. 493 of 2023 along with Misc Case 21 of 2025 and Misc Case 49 of 2025 from the Court of learned District Judge, 2nd Court at Durgapur, Paschim Bardhaman to the Court of Additional District Judge, Barasat, District- North 24 Parganas. 3. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the Matrimonial Suit has been filed in the Durgapur Court, by the husband/opposite party herein. 4. The petitioner/wife herein resides at 4D Bakultarani Apartment, Moulana Azad Road, Hridaypur, Barasat, Distrct-North 24 Parganas, West Bengal-700127 presently residing at 3rd Floor, Nandankanan, P.O- Madhyamgram Bazar, P.S.- Madhyamgram, District-North 24 Parganas, West 2 Bengal-700130 along with her child who has cerebral palsy. 5. Learned counsel for the husband/opposite party has placed the copies of ordersheets wherein it appears that the petitioner/wife has initiated a proceeding under Section 125 Cr.PC. before the learned Additional Chief Judicial Magistrate, Sealdah, South 24 Parganas being Case M-188/2022. 6. The opposite party says that if the prayer for transfer is considered then it may be transferred at Sealdah. 7. Considering that the wife resides in District North 24 Parganas and the husband resides at Paschim Bardhaman and the fact the petitioner has filed her case at Sealdah. The Matrimonial Suit be withdrawn from the Court of learned Additional District Judge, 2nd Court at Durgapur, Paschim Bardhaman and be transferred to the learned Additional District Judge, Sealdah for disposal. 8. CO 710 of 2026 is disposed of. 9. Parties to act on the server copy of this order. 10. Let a copy of this order be sent to the concerned Courts for immediate compliance. [Shampa Dutt (Paul). J]
