Learned advocate appearing for the petitioner submits that the petitioner is in custody since 20th September, 2025. Petitioner is innocent and has been falsely implicated in the present case.
Learned advocate for the de facto complainant opposes the prayer for bail.
Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the
2 witnesses as also the evidence of the victim.
Having considered that the victim was aged about 15 years at the time of commission of the alleged offence, an opportunity is granted. Learned trial court/special court would take steps so that the evidence of the victim is completed within a period of three months from the date of communication of this order. After the evidence of the victim is over, learned trial court would release the petitioner on bail on such terms and conditions as it deems fit and proper for ensuring further appearance before the learned trial court.
Accordingly, CRM(M)1419 of 2026 is disposed of.
Memo of Evidence submitted by the State be kept with the record.
