THIS WRIT PETITION, COMING ON FOR PRERLIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The Petitioner is before this Court seeking for the following reliefs: a. Call for the records. b. Issue writ of mandamus directing the respondent to consider the representation dated: 13.11.2025 are produced as Annexure-H,J, K and L by directing the respondents to release the entire bill amount of Rs.26,96,989/- in favour of the petitioner forthwith in the interest of justice and equity. c. Pass such other order/s as this Hon’ble Court deems fit, in the facts and circumstances of the case. - 3 - HC-KAR CNR: KAHC010116752026 NC: 2026:KHC:41999 WP No. 5113 of 2026 2. The petitioner having been issued various work orders in pursuance of tender claims to have completed the work and raised his invoices way back in the year 2022. Despite which only part payments having been made. The petitioner had submitted representations on 13.11.2025 at Annexures-H, J, K and L which have also not been considered. In that background the petitioner is before this Court seeking for the aforesaid reliefs. 3. Whenever bills are raised by the contractor and the employee, it is required for the employer to either accept the bills and make payment of the monies or reject the bills by giving reasons. The bills cannot be kept pending by a State Authority for nearly four years now without taking any action resulting in unnecessary litigation. 4. In that view of the matter, this Court passes the following: ORDER i) The Writ Petition is partly allowed. ii) A mandamus is issued directing the respondents to consider the representations of - 4 - HC-KAR CNR: KAHC010116752026 NC: 2026:KHC:41999 WP No. 5113 of 2026 the petitioner dated 13.11.2025 at Annexures- H, J, K and L within a period of 30 days from the date of receipt of a copy of this order. iii) It is made clear that this Court has not expressed any opinion on the entitlement of petitioner.
