Kausik (Allowed) CRM (M) 1093 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Maidan Police Station Case No. 75 dated 05.08.2022 under sections 120B/392/397/34 of the Indian Penal Code, 1860. And In the matter of : Sakil Halim @ Sakil Ahmed ……Petitioner. Mr. Sagar Saha Mr. Manojit Debnath ……for the Petitioner. Mr. Anurag Sardar ….for the State. Learned advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused person namely, Ershad Ekbal @ Shabbir who has been granted bail in CRM (M) 1621 of 2026. Learned advocate for the State opposes the prayer for bail but is unable to refute that petitioner and Ershad Ekbal @ Shabbir is not on the same footing. Accordingly, petitioner be extended the same benefit. Petitioner be released on bail on same terms and conditions as was imposed to Ershad Ekbal @ Shabbir in CRM (M) 1621 of 2026. 2 Accordingly, CRM (M) 1093 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
