The petitioners are apprehending their arrest in connection with Bagodar P.S. Case No. 137 of 2022, registered for the offence under Sections 341, 323, 324, 307, 354, 379, 504 and 506/34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that false allegation is made against the petitioners of making assault. He next submits that there are general and omnibus allegations against all the accused persons. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that besides the allegation of making assault, the allegation of mischief is also there. 5. From the FIR, it appears that the main allegation is against Amit Kumar Gupta (petitioner No. 1 herein) and Aditya Kumar Gupta [2026:JHHC:9283] -2- and there is no specific allegation against petitioner No. 2. 6. In view of the above, I am not inclined to grant anticipatory bail to petitioner No. 1 Amit Kumar Gupta. As such, his prayer for anticipatory bail is rejected. 7. So far as petitioner No. 2 is concerned, he is said to be aged about 58 years and there is nothing specific against him and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner No. 2 Anuj Kumar Gupta. 8. Accordingly, the petitioner No. 2, named above, is directed to surrender before the learned court within four weeks from today and in the event of his surrender / arrest, the petitioner No. 2, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Bagodar P.S.
