Mr. Moyukh Majumder … for the petitioner(s) Mr. Rajashree Venket Kundalia Ms. Nabanita Chatterjee Mr. Shaheen Ahmed … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners have been foisted with the present criminal case. Learned advocate for the State opposes the prayer for anticipatory bail and submits that the petitioners are the FIR named and charge-sheet has been submitted against them. However, on a specific query from the court, learned advocate submits a report which do not reflect that the petitioners have previous antecedents and/or any call date records and/or involvement in any money trail. 2 Having considered the same, I am of the opinion that the investigation of the case may continue but custodial detention of the present petitioners may not be warranted in the facts and circumstances of the case. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Md. Abdul Latif @ Abdul Latif and Md. Amir Sohel @ Amir Sohel] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2562 of 2026 is disposed of.
