JUSTICE SURAJ GOVINDARAJ - 3 - HC-KAR CNR: KAHC010552232026 NC: 2026:KHC:43275 WP No. 25094 of 2026 ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent Nos.1 and 2. 2. The petitioner is before this Court seeking for the following reliefs: (i) Issue a Writ in the nature of Mandamus, directing Respondent No.2 to consider the complaint dated 24-03-2026 filed under Section 25 & 26 of the Karnataka Societies Registration Act, 1960, as expeditiously as possible, vide Annexure-A. (ii) Pass such other order or orders as this Hon'ble Court deems fit and proper, in the interest of Justice and Equity. 3. The grievance of the petitioner is that the representation submitted by the petitioner for conducting an enquiry under Section 25 of the Karnataka Societies Registration Act, 1960, has not been considered by the respondents. 4. A perusal of Annexure-A indicates that allegations made are as regards falsification of official minutes of - 4 - HC-KAR CNR: KAHC010552232026 NC: 2026:KHC:43275 WP No. 25094 of 2026 meeting; passage of a resolution permitting use of maintenance funds for the personal legal defence of committee members; retrospective reclassification of expenditure and continued non-disclosure of financial records despite formal legal notice issued by the petitioner. 5. As regards the above aspects, it is the considered opinion of this Court that the dispute is between the members inter se and the Management of the Society. If at all the petitioner is aggrieved by any of the action and inaction on the part of the Management Committee of the Association, it is for the petitioner to avail of such civil remedies as are available and not to seek an enquiry or investigation under Section 25 of the Karnataka Societies Registration Act, 1960, such enquiry would only be necessary if the public purpose is served. - 5 - HC-KAR CNR: KAHC010552232026 NC: 2026:KHC:43275 WP No. 25094 of 2026 6. The present matter being a private lis, no public service being served, there cannot be a mandamus be issued for consideration of the representation at Annexure-A.
