19.08.2026 Court No.551 Item No.25 tbsr CRM (A) 2451 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NCB Crime No. 15/NCB/Kol/2024 dated 06.09.2024 under Sections 8(C) read with 21(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of: NETAI MONDAL @ NETAI
….Petitioner. Mr. Avik Ghatak Mr. Dibyo Mukherjee
…for the petitioner. Mr. Dipankar Dandapat Mr. Tapadip Gupta
…..for the Union of India/NCB. 1. Report filed on behalf of the NCB is taken on record. 2. The petitioner prays for anticipatory bail on the ground of parity. 3. It is submitted that accused Palash Mondal and Tarak Saha were granted anticipatory bail on the ground that the aforesaid persons were implicated in this case on the basis of the statement of a co- accused made while in custody. In such order noted that the aforesaid petitioners Tarak Saha and Palash Mondal had no phone call conversation with any of the persons who were arrested with the commercial quantity of narcotic contraband. 4. According to the prosecution, the petitioner Netia Mondal is alleged to be the arranger of line men escorting the vehicle to the godown belonging to one Goutam Mondal. It was also stated that he was in regular contact with Goutam Mondal, as is evident from the call detail records. The said Goutam Mondal was also granted bail by an order passed on January 21, 2026 in CRM (NDPS)
2 1465 of 2025. The petitioner has sought the anticipatory bail on the ground of parity with Tarak Saha, who was granted anticipatory bail by an order passed on March 11, 2026 in CRM(A) 397 of 2026 and that of Palash Mondal, who was granted anticipatory bail on April 7, 2026 in CRM(A) 1047 of 2026. 5. Apparently nothing was recovered from the possession of the present petitioner. He was named in the First Information Report on the basis of the statement recorded by co-accused while in custody. 6. Such claim of parity has not been disputed by the learned advocate for Narcotics Control Bureau. 7.
In view of the above and the fact that the only material available against the petitioner is the phone call conversations between him and two other co-accused from whom no contraband had been recovered, the petitioner has been able to rebut the restriction contained in Section 37 of the NDPS Act and considering the other materials available from the investigation, the fact that a substantially similarly circumstanced co-accused was granted anticipatory bail by this Court, and the fact that charge sheet has already been filed, I am inclined to grant anticipatory bail to the petitioner. 8. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the
3 petitioner shall not threaten or intimidate the witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court. 9. Accordingly, the application for anticipatory bail is allowed. 10. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
