This Criminal Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus directing the respondents to immediately produce the petitioner's son Jaswant Singh @ Gobinda, daughter Baljeet Kaur and relative Sarbjeet Kaur, who are illegally detained since last 16 hours in illegal police custody at Police Station Ghall Kalan or CIA Office, Moga, and to set them at liberty forthwith; and further to appoint a Warrant Officer or order an independent Magisterial/CBI inquiry into the illegal detention, custodial torture, interrogation without any legal basis, and threat of false implication/fabrication of a criminal case; and to issue consequential directions including strict action against the erring police officials, immediate medical examination of the detenues by an independent doctor, and award of appropriate compensation. 2. This petition has been filed on the grounds that Jaswant POONAM 2026.07.24 12:26 I attest to the accuracy and integrity of this document CRWP-8598-2026 (O&M) 2 Singh @ Gobinda, Daughter Baljeet Kaur and Sarbjeet Kaur are illegally detained in the Police custody at Police Station Ghall Kalan or CIA Office, Moga. A Warrant officer was appointed vide order dated 17.07.2026. The Warrant officer has submitted his report, which is taken on record. 3. As per report, Warrant Officer reached the premises of CIA Office, Moga at 9.45 pm on 17.07.2026 but detenues were not found there. Thereafter, he reached Police Station Mahana, District Moga at 10.30 pm, there also none of the detenues were found. Statement of petitioner-Samuel was also recorded by the Warrant Officer to that effect. 4. Learned counsel for the petitioner submitted that, on that day, police officials had smartly taken away the detenues out of CIA staff Office from the back gate and the person who assisted the petitioner in locating CIA Staff Office was later on illegally detained and was released only at 3.00 am on the next day. 5. It is further submitted that the detenue-Jaswant Singh is available through video conferencing before this Court. Since, detenue has been traced, as per the report of the Warrant Officer, they were not found with the respondents. The present petition stands disposed of. Petitioner can take any action in accordance with law. 6. Pending misc. application (s), if any, shall also stand disposed of.
