IN THE HIGH COURT AT CALCUTTA COMMERCIAL DIVISION ORIGINAL SIDE
AP-COM/218/2026
KHAGRA JOYDEV RESOURCES PRIVATE LIMITED VS DAMODAR VALLEY CORPORATION
BEFORE:
The Hon’ble JUSTICE GAURANG KANTH Date : 31st March, 2026. Appearance Mr. Shounak Mukhopadhyay, Adv. Mr. S. Choudhury, Adv. Mr. A. Poddar, Adv. …for the petitioner
Mr. Pradip Tarafdar, Sr. Adv. Mr. Subir Pal, Adv. …for the respondent
The Court: The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award.
Learned Counsel for the petitioner submits that this Court vide order dated 12.05.2023 had appointed a learned sole arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 18.10.2023. This Court on earlier two occasions i.e., vide orders dated 29.04.2025 and 22.09.2025 extended the mandate of the arbitral tribunal by six months each for publication of the award as arguments were completed on
17.11.2024. However, despite two extensions, the award has not yet been furnished.
Learned Counsel for the respondents states that he has no objection to the extension of the mandate of the arbitral tribunal.
2 Upon consideration of the advanced stage of the present arbitral proceedings, this Court is granting further extension of two months to the learned Sole Arbitrator to publish the award. The learned arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period. With the aforesaid observations, the present petition stands disposed of.
