Let supplementary affidavit filed by the petitioner be kept on record. 2. The petitioner has been in service of the respondent no. 2 since 2011. The petitioner was appointed and retired as a Khalasy. 3. However, according to Mr. Sengupta, learned Advocate appearing for the petitioner, he had, for a substantial period of time after his appointment, worked as a Welder and had rendered service till about 2024 when he retired from service. 4. Mr. Sengupta fairly submits that the petitioner was appointed as a Khalasy and was never promoted though he worked with utmost diligence and efficiency. In fact, he produced a recommendation from the Joint Managing Director that the petitioner be promoted on account of his efficiency. However, 2 no steps have been taken. In the facts and circumstances of the case, no right has accrued to the petitioner, except may be for a legitimate expectation. 5. Petitioner had made a representation on March 27, 2024 before the respondent no. 4, seeking benefits on the basis of the fact that he had discharged his duties as a Welder. This representation has not yet been considered. 6. Respondent no. 4 is directed to consider the representation of the petitioner dated March 27, 2024, within a period of six weeks from date. 7. The consideration of the representation will not create any right or equity in favour of the petitioner. 8. With the aforestated direction, the writ petition is disposed of. 9. There will be no order as to costs. 10. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (Reetobroto Kumar Mitra, J.)
