1. By filing the present petition, the petitioner has prayed for the following reliefs:-
“10.1 The Hon'ble Court may kindly be pleased to quash the the impugned order dated 23.07.2026 passed by the respondent no. 2 and further the respondent no.2 is YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.08.25 10:24:18 +0530

directed to issue permit as per application of the petitioner or provide an opportunity to the petitioner as per section 80 (2) of the M.V. Act. 10.2 Any other relief which this Hon'ble Court may deems fit and proper looking to the facts and circumstances of the case may also be awarded to the petitioner including the cost and expenses of this petition.”

After arguing for some time, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to approach before the concerned STAT and in-turn concerned STAT may be directed to decide the same in accordance with law after giving due opportunity of hearing to the parties concerned and to pass appropriate order within some specific period.
3. No objection has been raised from the other side.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the facts and circumstances of the case and further considering the fact that if the petitioner approaches before the concerned STAT within a period of 15 days, the concerned STAT is directed to consider the same and to decide the same within a period of ‘45 days’ after giving notice to all the objectors.
6. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.

7. Certified copy of all the annexures be returned to the learned counsel for the petitioner after obtaining photostate copies of the same.
