1. There is acrimony in between petitioner and her daughter-in-law being respondent no. 4 which gave rise to criminal prosecution being Balagarh Police Station Case No. 403 of 2025 dated 17th August, 2025 under certain provisions of BNS.
2. On completion of investigation charge sheet dated 30th November, 2025 was filed before the jurisdictional Magistrate. Such prosecution was initiated based on complaint of respondent no. 4.
3. Subsequently, complaint was lodged by the petitioner dated 29th May, 2026 and grievance of petitioner is taking note of such complaint appropriate steps have not been taken by the police authorities. Prayer is also made for
2 directing concerned police authorities to provide protection.
4. However, from communication dated 7th July, 2026 of Officer-in-Charge, Balagarh Police Station, Hooghly it appears that respondent no. 4 is not staying at the house of her in- laws. Since petitioner and respondent no. 4 are staying separately there is no need to give direction upon the concerned police authority to provide protection to the petitioner as sought for in this writ petition.
5. However, if petitioner is aggrieved by inaction on the part of concerned police authority to take steps based on complaint dated 29th May, 2026, petitioner shall be at liberty to approach jurisdictional Magistrate under Section 175(3) BNSS 2023 in pursuit of remedy.
6. Present writ petition stands disposed of.
7. Communication dated 7th July, 2026 of Officer-in-Charge, Balagarh Police Station filed on behalf of State respondents is taken on record and copy of same is made over to the learned advocate representing petitioner and private respondents.
