Petitioner has come up before this Court against the show cause notice issued by respondent No. 4, calling upon him to show cause as to why his temporary license JKEL-2 in respect of JMC Ward No. 49-E in City Excise Range South, Jammu, be not cancelled. This license was issued for the period 2025-26. 2. Learned counsel for the petitioner submits that since the period for which license was issued is already over now, this petition only survives to the extent of release of his EMD (Earnest Money) of Rs. 10 lacs deposited by the petitioner at the time of obtaining the license. He further submits that the petitioner would be satisfied, in case the respondents are directed to release the EMD, as the period of the license is already over. 3. Learned counsel for the respondents is not averse to the proposition made by learned counsel for the petitioner. 4. With the consensus of the parties and also keeping in view the nature of controversy involved, this petition is disposed of with a direction to respondent No. 2 to process and release the EMD amount strictly in terms of contract and law governing the subject, within a period of three weeks from the date, a copy of this order is made available to the said respondent. 5.
