02/ 02.04.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 147, 148, 149, 341, 342, 323, 332, 353, 504, 506, 307 of the Indian Penal Code.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.

Learned counsel for the State opposes the prayer for bail.
4. It is alleged that, the accused were illegally fishing in the forest area in Patura Jheel. When the informant, who is a forest guard, tried to forbade them, the accused abused and assaulted him, as a result of which altercation took place.
5. The petitioner is in custody since 28.01.2026. Though one of the Sections applied is Section 307 of the Indian Penal Code but from the materials available on record, prima facie it is not established as to whether Section 307 of the Indian Penal Code can be attracted in this case or not. Further, a Co-ordinate Bench of this Court has already granted bail to the co- accused, namely, Mahavir Rajwar in B.A. No.2639 of 2026 vide order dated
01.04.2026.
6. Considering the aforesaid fact, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be
released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rajmahal, in connection with Tinpahar P.S. Case No.29 of 2024, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Rajmahal once in a month till the disposal of the trial.
