Hon'ble Shri Justice Amitendra Kishore Prasad Order On Board 17.08.2026 1. Heard. 2. This MCC has been filed by the applicants seeking modification of the order dated 04.08.2026 passed in WPC No. 225 of 2023, insofar as it relates to the Khasra Nos. mentioned in paragraph 2 thereof. 3. Learned counsel for the applicants would submit that WPC No. 225/2023 was disposed of by this Court vide order dated 04.08.2026. She submits that, in the said order, the Khasra Nos. mentioned in the 16th and 17th lines of paragraph 2 have inadvertently been typed as Khasra Nos. 211, 1820 and 1877, whereas the correct Khasra Nos. are 811, admeasuring 0.22 acre, and 812, admeasuring 0.08 acre. She, therefore, prays that the aforesaid Khasra Nos. be corrected accordingly. 4. No objection has been raised from other side to the modification sought for. 5. I have gone through the impugned order including the record and the mistake appears to be bona fide on the face of record, which needs to be rectified. Therefore, para 02 of the order dated 04.08.2026 be read as under:- 3 “02. Learned counsel for the petitioners submits that the allegations raised in the present petition are of a serious nature. It is contended that one of the ponds situated in the village is being illegally filled up for the purpose of raising construction thereon. Being residents of the said village and the complainants in the matter, the petitioners have approached this Court seeking appropriate directions for taking necessary action against respondent No. 5. It is further submitted that the petitioners had earlier preferred a representation before respondent No. 2, namely the Collector, District Janjgir-Champa (C.G.), requesting appropriate action in the matter. However, the said representation has neither been considered nor decided by the competent authority, compelling the petitioners to invoke the writ jurisdiction of this Court. He next submits that the petitioners have placed on record a copy of the Vajibul Arj pertaining to District Janjgir-Champa, which reveals that the land bearing Khasra Nos. 811 area 0.22 acre and 812 area 0.08 acre is recorded as a pond and a small pond in the revenue records. It is, therefore, contended that the said land is required to be preserved exclusively for its recorded purpose and 4 cannot legally be utilized for any other purpose. Consequently, any attempt to fill up the pond and raise construction thereon is contrary to law and liable to be restrained.” 6. Copy of this order be supplied to learned counsel for the applicants. 7. Accordingly, the MCC stands allowed in the aforesaid terms. Sd/- (Amitendra Kishore Prasad) Judge U.K. Raju
