Sl.18 19.08.2026 Court No.6 BP C.O. 2722 of 2026 Sri Dhirendra Nath Halder -versus- Sri Subrata Halder & Anr. Mr. Manas Mitra Mr. Abhishek Biswas ..for the petitioner The immediate grievance of the petitioner is that the District Magistrate who is the Appellate Tribunal under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 read with Rule 9 of the West Bengal Maintenance and Welfare of Parents and Senior Citizens Rules, 2008 has not yet fixed a date of hearing of the appeal filed by the petitioner on June 17, 2026 challenging the order dated 18th February, 2026 passed by the Chairman, Maintenance Tribunal, Barasat (Sadar), 24 Parganas (North). C.O. 2722 of 2026 stands disposed of by directing the District Magistrate to dispose of the appeal filed by the petitioner on 17th June, 2026 by passing a reasoned order after affording an opportunity of hearing to the petitioner and the opposite parties. The entire exercise shall be completed by the District Magistrate as expeditiously as possible but positively within a period of sixteen weeks from the receipt of a server copy of this order together with a copy of the appeal petition filed by the petitioner. 2 There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
