This petition has been filed under Section 482 Cr.P.C (Section 528 of BNSS) for quashing of order dated 07.08.2025 passed by ld. JMIC, Batala in complaint case bearing NACT No.314 of 2022, titled as “Baljeet Kaur vs. Manjinder Singh” whereby the petitioner was declared as proclaimed person. 2. Learned counsel for the petitioner submits that the petitioner has been regularly appearing before the trial court and unfortunately he met with an accident and sustained serious injuries in his left hand and has to undergo surgery at Goraya Hospital Batala and remained admitted there from 22.10.2024 to 24.10.2024. He further submits that the ld. trial Court ordered issuance of proclamation against him on 07.08.2025. He further submits that mandatory provisions of Section 82(2) (i) of Cr.P.C has not SEEMA SHARMA 2026.07.24 13:14 I attest to the accuracy and authenticity of this order/judgment CRM-M No.40316 of 2026 -2- been complied with. As such the learned trial Court had cancelled the bail orders of the petitioner and his bail bonds and surety bonds were ordered to be forfeited to the State and petitioner was ordered to be summoned through non-bailable warrants of arrest. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order declaring the petitioner proclaimed person be set aside. 3. I have heard learned counsel for the petitioner and gone through the case file. 4. In view of the above, this Court does not find any legitimate ground to interfere in the impugned order dated 07.08.2025 passed by ld. JMIC, Batala. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today and moves an application for grant of regular bail, on his doing so, the trial Court is directed to consider and decide the same within a period of 02 days, in accordance with law. 5. With these observations, the present petition stands disposed of.
