According to the prosecution story, it is alleged that the Applicant enticed the victim on a false promise of marriage and on 23.06.2023, took her to Gracious College grounds and thereafter to Palm Hotel, where he established physical relations with her without her genuine consent on deceitful pretexts. It is further alleged that the Applicant continued to maintain physical relations with the victim on the same promise of marriage till January 2026. Based on these allegations, the offences as mentioned above have been registered against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that there is an unexplained delay of more than three years in lodging the FIR, despite the alleged relationship having commenced in June 2023 and continued till January 2026. It is submitted that the allegations arise out of a failed relationship between two consenting adults and that the parties had also executed a consent deed. He further submits that an earlier complaint was investigated by the police and NCR No.297/2025 was
3 registered, but no offence was found to be made out and the present FIR has subsequently been lodged on the basis of a fresh complaint. It is also submitted that the allegations regarding secret video recording and criminal intimidation are vague and unsupported by any electronic or other material. He lastly submits that the trial is likely to take considerable time for its conclusion, therefore, the Applicant may be granted anticipatory bail. 4. Per contra, learned State Counsel opposes the bail application and submits that as per the statement of the victim recorded under Section 183 of the BNSS, the Applicant repeatedly established physical relations with her after administering a cold drink, recorded the same on video and continuously induced her on the promise of marriage. It is further submitted that the Applicant had even executed marriage agreements with the victim on three occasions and subsequently blocked her number and refused to marry her, pursuant to which the present complaint was lodged, therefore, considering the serious nature of the allegations, the Applicant is not entitled to bail. 5. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the relationship between
4 the Applicant and the victim continued for a considerable period from June 2023 to January 2026, the fact that there is considerable delay in lodging the FIR and the fact that an earlier complaint was investigated by the police pursuant to which NCR No.297/2025 was registered, without further commenting anything upon the merits of the case, this Court is of the considered opinion that it is a fit case to allow the application. 6.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Balbeer Singh Taneja on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such fact to the Court. (b) The Applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant/s shall appear before the trial Court on each and every date given to him/her/them by the said Court till disposal of the trial. (d)The Applicant/s and the surety shall submit a copy of his/her/their adhaar card along with a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant/s
