Learned advocate appearing for the petitioner submits that the subject matter of the instant case relating to alleged recovery of 5.808 kg. of brown sugar. Petitioner is in custody for more than seven and half months. Charge sheet has been submitted before the jurisdictional court. Petitioner prays for bail on any stringent condition as there is no possibility of the trial being concluded. Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner was conscious and present in the vehicle from where seizure was effected. Having considered the subject matter of the case and the quantity seized, I am of the opinion that the rigours of Section 37 of the NDPS Act attracted. 2 As such, the prayer for bail of the petitioner in CRM (NDPS) 1571 of 2026 is dismissed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
