CORAM: HON'BLE MR. JUSTICE VENKATESH NAIK T ORAL ORDER A joint memo has been filed by the petitioner and the respondents in this case. 2. The terms of settlement entered into between the parties are recorded in the joint memo, which reads as follows:-
"1) The petitioner has filed this Criminal Revision challenging the order passed by the Addl. District Sessions Judge Mysuru Vide dated 11.9.2025 in Criminal Appeal No.417/2024 confirming the order

HC-KAR CNR: KAHC010670582025 NC: 2026:KHC:42667 CRL.RP No. 1534 of 2025 passed by the Trial court in CC No.7311/2021 vide dated 2.12.2024 on the file of V Addl. Civil Judge JMFC at Mysuru. 2. It is submitted that the Respondents have filed C C 7311/2021 on the file of V Addl. Civil Judge Mysuru for the alleged offence committed under sec 138 of NI Act on the issuance of Cheque No 499406 dated 8.3.2021 for a amount of Rs.2,50,000/-. The said case was allowed and the petitioner preferred Criminal Appeal No.417/2024 on the file Addl. Dist Sessions Judge Mysuru and the Said Hon'ble court confirmed the order passed by the trial by dismissing the said Appeal via judgment dated
11.9.2025. The Trial court has ordered the petitioner to pay Rs.2,65,000/- as fine and out of the said amounts Rs.2,60,000/- has to pay to the respondents and Rs.5,000/- to the Government. Hence the petitioner have challenged this Revision against the order passed by the Appellant and trial court as stated above. 3. The petitioner have deposited Rs.1,56,000/- as per the orders of this Hon'ble court. 4. The both the parties have settled the matter and the both the parties have agreed for a sum of Rs.1,56,000/-(Rupees One Lakh Fifty Six Thousand only) which is already being deposited by the petitioner in the trial court vide D D No.569816 draw on State Bank of India Hootagalli Branch vide dated 4.4.2026 as full and final settlement. The petitioner have no objection for the respondent to withdraw the said amount as stated above. 5. The both parties have no future claims each other. 6. The both the parties a have agreed as per condition mentioned above in joint memo."

Learned counsels for the parties submit that the matter has already been settled between the parties. In view of the joint memo, the parties have settled the matter and both parties have agreed for a sum of Rs.1,56,000/-, which is in full and final settlement. 5. In view of the settlement entered into between the parties and the terms of the joint memo, the Trial Court is directed to release the amount of Rs.1,56,000/- in deposit before it in favour of the respondents, on proper identification, in accordance with law. 6. The terms of settlement are recorded. 7. In terms of the joint memo, the appeal stands
disposed of.
