Learned advocate appearing for the petitioner submits that petitioner is in custody for a period of 7 years and 2 months. Till date 4 witnesses have been examined and the prosecution has relied upon 21 witnesses in order to prove its case.
Learned advocate for the State submits that State cannot solely be responsible for the delay and the State has proposed to examine 17 witnesses.

Having considered that the petitioner is in custody for 7 years and 2 months, I am of the opinion that petitioner be released on bail as some time will be required to take the trial to its logical conclusion.
Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sandip Sardar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1095 of 2026 is allowed.
