JUSTICE M.I.ARUN ORAL ORDER The petitioner has filed the writ petition challenging the order passed by the Assistant Commissioner under Section 5 of the Karnataka Scheduled Castes and - 3 - HC-KAR CNR: KAHC010326592025 NC: 2026:KHC:39907 WP No. 14255 of 2025 Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (for short, 'the PTCL Act'). 2. This Court, on 15.05.2025 had passed the following interim order. The same reads as under: "Petitioner is before this Court being aggrieved by the order dated 14.02.2025 passed by the respondent No.2 under Sections 4 and 5 of KPTCL Act, 1978. Though appeal provision is provided, counsel for the petitioner submits that there is no sitting, constrained him to approach this Court by way of filing this writ petition. Learned HCGP is directed to take notice for the respondent Nos.1 and 2. Issue notice to the respondent No.3. There shall be an order of status quo till the next date of hearing. List on 23.06.2025." 3. It is seen that the petitioner is having an alternative and efficacious remedy under Section 5A of the PTCL Act. - 4 - HC-KAR CNR: KAHC010326592025 NC: 2026:KHC:39907 WP No. 14255 of 2025 4. For the aforementioned reasons, the Writ Petition is hereby dismissed, reserving liberty to the petitioner to approach the appropriate Appellate Authority in the manner known to law. 5. If he were to file an appeal, he would be entitled to the benefit under Section 14 of the Limitation Act, 1963. Further, the interim order granted by this Court on 15.05.2025 shall continue for a further period of four (04) weeks from today. 6. Pending I.As., if any, stand disposed of.
