In the present writ petition, following prayers have been made:- “Civil writ petition under Articles 226 and 227 of the Constitution of India praying for a writ of certiorari other appropriate writ, order or direction in the nature thereof thereby quashing/setting aside Licence bearing No.-193 of 2025, Dated 10-10-2025 (Annexure P-1) granted by the Respondent No. 2 in favour of the Respondents No. 3 to 7; And Issue a writ, order or direction in the nature of Mandamus directing Respondent No. 2 to reconsider the grant of Licence No. 193 of 2025 after taking into account the pendency of Civil Suit No. 143 of 2023 and the Petitioner's claim in respect of the land forming part of the licensed area; PAWAN KUMAR 2026.07.24 11:03 I attest to the accuracy and authenticity of this document CWP-22541-2026 [2] And Further for a writ, order or direction in the nature of Mandamus directing Respondent Nos. 3 to 7 from creating third-party rights, alienating, transferring, allotting or otherwise dealing with that portion of the licensed land which forms the subject matter of Civil Suit No. 143 of 2023 during pendency of the present writ petition; And Further, staying the operation of issuance of aside Licence bearing No.-193 of 2025, Dated-10-10-2025 (Annexure P-1) granted by the Respondent No. 2 in favour of the Respondents No. 3 to 7; during the pendency of the present petition. And Further, during the pendency of the present case, status quo be maintained on the land for which the Licence bearing No.-193 of 2025, Dated- 10-10-2025 (Annexure P-1) has been granted. And/or Any other writ, order or direction which this Hon'ble court may deem fit and proper keeping in view the peculiar facts and circumstances of the present case.” 2. Learned counsel for the respondents-State has submitted that since the licence has been issued by the Director, Town and Country Planning, Haryana and apparently the petitioner is aggrieved by the grant of the said licence, thus, there is remedy of appeal under Section 19 of the Haryana Development and Regulation of Urban Areas Act, 1975. 3. Learned counsel for the petitioner has submitted that since the copy of the licence was never forwarded to the petitioner and it is only now that the petitioner learnt about the same, thus, has prayed that the petitioner be permitted to withdraw the present writ petition with liberty to file an PAWAN KUMAR 2026.07.24 11:03 I attest to the accuracy and authenticity of this document CWP-22541-2026 [3] appeal, in accordance with law but has prayed that in case the appeal is filed within a period of one month from today, then the Appellate Authority be directed not to dismiss the same solely on the ground of limitation. 4. In view of the same, the present writ petition is dismissed as withdrawn with liberty to the petitioner to file an appeal, in accordance with law.
