In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the 4th respondent is dispensed with. 2. This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation of petitioner dated 12.03.2026 with regard to cancellation of the transfer of allotment in favour of the 4th respondent bearing Old No.E.16 New No.J9 Vazhaithoppu Scheme, West Mambalam, Chennai 600033. https://www.mhc.tn.gov.in/judis WP No. 20985 of 2026 __________ Page3 of 6 3. Brief facts: Petitioner is a senior citizen and the original allottee of the tenement bearing Old Plot No.E.16, New Plot No.J.9, Vazhaithoppu Scheme, West Mambalam, Chennai 600 033. Allotment was granted to petitioner by Tamil Nadu Urban Habitat Development Board vide proceedings dated 26.12.1980 in Na.Ka.No.1106/A3/80. 4. Learned counsel for petitioner would submit that petitioner had been residing in the said premises for more than three decades and had regularly paid the monthly instalments to the Board. According to learned counsel, around 2008, the entire cost of tenement had been discharged by petitioner. It is submitted that petitioner had thereafter permitted his brother’s wife Mrs.Anandhi / fourth respondent herein to reside in the said premises while he shifted to a rental accommodation. The learned counsel would further submit that sometime in the year 2012, petitioner discovered that the fourth respondent had obtained a transfer allotment in her name without his knowledge much less consent. It is further submitted that petitioner has since made representations on more than one occasion to the Authorities, including the third respondent, seeking redressal of his grievance. https://www.mhc.tn.gov.in/judis WP No. 20985 of 2026 __________ Page4 of 6 5. Learned Standing Counsel appearing on behalf of the third respondent would submit that on the basis of various representations made by petitioner, enquiry has commenced. He would further submit that a period of two weeks may be granted to complete the enquiry and pass appropriate orders. Agreed to by the learned counsel for petitioner. 6. In view of the same and taking into consideration the facts and circumstances of the case, there shall be a direction to the respondents to complete the enquiry based on petitioner’s representation and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner, 4th respondent and any other interested persons within a period of two (2) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law. 7. Accordingly, the writ petition stands disposed of.
