The order dated 06.02.2024 passed by the first respondent vide Annexure-G is challenged in this writ petition - 3 - HC-KAR CNR: KAHC010735662024 NC: 2026:KHC:44236 WP No. 34841 of 2024 on several grounds as set out in the memorandum of the writ petition. 3. Counsel for Sri. V. S. Naik, following instructions from respondent No. 2 - Union, submits that all eligible employees have received the entire 17-B wages. Therefore, the Union is not insisting on prosecution. Hence, counsel submits that the order allowing prosecution be set aside. 4. Noting counsel for respondent No.2's submission that the full 17-B wages are paid to all eligible employees, the second respondent's union is not insisting on permission to prosecute. The order dated 06.02.2024 issued by the first respondent vide (Annexure-G) is hereby quashed. 5. Resultantly, the writ petition is allowed.
