The first bail application of the applicant has been dismissed on merits vide order dated 23.07.2026 passed by this Court in MCRC No. 6187/2026. 3. The applicant has been arrested on 01.06.2026 in connection with Crime No. 262/2026 registered at Police Station – Kharsia, District – Raigarh (C.G.) for the offence under Section 7 of the Chhattisgarh Gambling Prohibition Act, 2022, Section 112(2) & 3(5) of Bharatiya SUMIT KUMAR Digitally signed by SUMIT KUMAR Date: 2026.08.18 11:30:35 +0530 2 Nyaya Sanhita, 2023. 4. The case of the prosecution is that on 31.05.2026, Kharsia Police received a secret information that present applicant is engaged in online gambling. When the police party conducted raid at the suspected place i.e. Gun Bazar, they found the applicant in front of the house of Gagan Agrawal. On being interrogated, he disclosed that he was engaged in playing online gambling along with other co-accused Gagan Agrawal, Rikesh Rai, Arjun Rathore and Sahil Agrawal. When the police conducted raid in the house of accused Sahil Agrawal, he fled away, however, from his house, cash amount of Rs.31,99,700/- and a currency counting machine was seized. From the mobile phone of Gagan Agrawal, grandexch.com and from the mobile phone of Shubham Agrawal, radheexch.com online gaming app was recovered. FIR was registered and he was arrested on 01.06.2026 in which he is claiming regular bail. 5. Learned counsel for the applicant would submit that at the time when the first bail application of the applicant has been dismissed on merits, the charge-sheet was not filed and subsequent to that the charge-sheet has been filed on 29.07.2026. From perusal of the charge-sheet, it transpires that only Rs. 12,000/- has been seized from the present applicant alongwith his mobile phone and all other incriminating material has been seized from the co-accused Gagan Agrawal and Sahil Agrawal. Only one offence has been previously registered against the present applicant. Final adjudication of the case will take it some time, the investigation has been completed, therefore, he has filed the second bail application. 3 6. On the other hand, learned counsel appearing for the State opposes and have submitted that the first bail application of the present applicant has been rejected on merits recently vide order dated 23.07.2026 and there is sufficient evidence against the present applicant in the charge-sheet that he alongwith other co-accused persons involved in playing online gambling and receiving illegal betting money, therefore, he is not entitled for bail. 7. I have heard learned counsel for the parties and perused the document annexed with the bail application. 8. Considering the fact that the first bail application of the present applicant has been dismissed on merits vide order dated 23.07.2026 passed in MCRC No. 6187/2026, after considering the allegation against the present applicant available in the case diary, mere filing of the charge-sheet does not considered to be change in circumstances, I am not inclined to admit this second bail application of the applicant as there is network and syndicate of the accused persons for playing online gambling and huge cash amount of Rs. 31,99,700/- has been seized from the house of Sahil Agrawal and from his disclosure statement, the other accused persons and other articles of gaming platform have been recovered. 9.
