This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 42/2026 registered at Police Chowki – Latori, Police Station – Jaynagar, District – Surajpur (C.G.) for the offence punishable under Section 296, 351(3), 115(2) and 109(1) of the BNS. 2. Case of the prosecution, in brief, is that on 09.02.2026 the complainant Pannalal lodged written report at Police Chowki-Latori, alleging therein that on 08.02.2026 at around 9.30 PM, the complainant and Deepak Kumar, Chuneshwar Rajwade, Talkeshwar Rajwade, Devnarayan & Santram went to the house of applicant for RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 meeting, at that time, at around 10.00 PM, the applicant came in the house from outside, abused & assaulted to Talkeshwar with the help of wooden club, due to which, Talkeshwar received head injury and during scuffle, the complainant tried to caught hold to the applicant, upon which, the applicant also inflicted injury upon the complainant. Hence, this application. 3. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the applicant is in jail since 28.06.2026, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the applicant is said to have assaulted the injured with hard and blunt object on his head, due to which he sustained injuries, and as per the MLC Report and the doctor’s opinion, the injuries are said to be grievous in nature. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant is said to have assaulted the injured with hard and blunt object on his head, due to which he sustained injuries, and as per the MLC Report and the doctor’s opinion, the injuries are said to be grievous in nature, 3 therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, this bail application of applicant – Kamal Rajwade, involved in Crime No. 42/2026 registered at Police Chowki – Latori, Police Station – Jaynagar, District – Surajpur (C.G.) for the offence punishable under Section 296, 351(3), 115(2) and 109(1) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
