Learned advocate appearing for the petitioner submits that pursuant to the order of bail being granted on 11.03.2025 by the learned Additional Chief Judicial Magistrate, Rampurhat, the present petitioner was subjected to assault and bleeding injuries for which information was furnished to the police authorities and consequently a case was registered. Learned advocate appearing for the State has submitted Memo of Evidence. Let the same be kept with the record. Learned advocate appearing for the opposite party nos.2, 3 and 4 opposes the prayer which has been advanced in the application. I have taken into account the overall circumstances. Admittedly a subsequent FIR was registered in the present case. However, such issue of cancellation of bail which was 2 granted by the learned Additional Chief Judicial Magistrate, Rampurhat was not called upon to be adjudicated by the same court which granted bail. Petitioner be well advised to approach the learned Additional Chief Judicial Magistrate, Rampurhat wherein the accused/opposite parties were granted bail. Learned Additional Chief Judicial Magistrate, Rampurhat, on an application preferred by the present petitioner, would consider the genuinity of the allegations and decide the same in accordance with law. At this stage, no interference is made by this Court. However, the learned Additional Chief Judicial Magistrate, Rampurhat will abide by the directions passed above. With the aforesaid observations, the application for cancellation of bail being CRM (R) 98 of 2025 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
