Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 591 grams of Heroin. There is no possibility of the trial being taken to its logical conclusion as till date charges have not been framed. Learned advocate appearing for the NCB has referred to the chemical examiner’s report including the number of witnesses proposed to be examined. Having considered that the quantum so seized is of commercial quantity, I am of the opinion that rigors of Section 37 of the NDPS Act is attracted. Further, at this stage, the chemical 2 examiner’s report is of no assistance to the present petitioner. Having considered that the petitioner is in custody for more than a year, I direct the learned trial court to give priority for deposition of the independent seizure list witnesses, preferably within a period of 60 days from the date of overcoming the consideration of charges. In case any accused is absconding, learned special court would exhaust the process of law at the earliest and fix date for consideration of charges. Accordingly, CRM(NDPS)1562 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
