1. Learned advocate for the petitioner submits that the present petitioner is the wife of the alleged victim who committed suicide. As per the allegation made in the FIR, the husband committed suicide due to family disputes. As the victim was a habitual drunkard, the petitioner left her matrimonial house. The victim went to the paternal house of the petitioner to bring her back, but the petitioner refused. As a result of her refusal the victim/husband committed suicide. 2. Learned advocate for the petitioner further submits that the charge-sheet has already been submitted. He prays for anticipatory bail. 3. On the other hand, learned advocate for the State opposes the prayer for anticipatory bail and submits that the victim committed suicide as the petitioner, the wife of the victim, had an illicit relationship with
2 another person. Such person is an accused in this case and he has already been granted bail by the jurisdictional court. The investigation of the case has already ended in a charge-sheet. She has been absconding. 4. I have gone through the materials available in the case diary as well as considered the submissions made on behalf of the parties. The post-mortem report shows an oblique/non-continuous ligature mark. The autopsy surgeon opined that the death was the effect of asphyxia due to hanging which establishes suicide. There were allegations and counter allegations. As per the allegations made in the FIR, the petitioner had an illicit relationship with some other person which drove the victim to commit suicide. According to the case of the petitioner, the victim committed suicide as she refused to return to her matrimonial house. 5. Be that as it may, the investigation of the case has ended in a charge-sheet.
As to how far the present petitioner has abetted the commission of suicide by the victim, the matter has to be determined at the trial, after going tthrough the prosecution evidence. 6. In such circumstances, the prayer for anticipatory bail of the petitioner is allowed. 3

Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall report before the investigating officer once in a month until the conclusion of the trial and the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 8. The Prayer for anticipatory bail of the petitioner is allowed. 9. CRM (A) 2420 of 2026 is disposed of. 10 .
