1. Affidavit-of-service filed be kept with the record.
2. The writ application has been preferred praying for direction upon respondent no. 2 & 3 being the State Labour Commissioner and the Additional Labour Commissioner to consider the petitioner’s representation dated 23th March, 2026.
3. It appears that the said representation is pending consideration since 23th March, 2026. The petitioner has also prayed for direction that the respondent no. 4 be prohibited from participating in any of the meetings of the respondent authorities.
4. On hearing the learned counsel appearing for the respondent no. 4, it appears that earlier the respondent no. 4 was an office bearer of the said union. Admittedly, at present the respondent no. 4 is
2 not an office bearer of the union and is now an outsider.
5. The petitioner contends that the respondent no. 4 being an outsider cannot represent any Section of the workers and more so the disputes of such nature being industrial disputes.
6. On hearing the learned counsels for the parties, the writ application is disposed of with the direction that the respondent no. 3 shall consider the said representation dated 23th March, 2026 filed by the petitioner within 30 days from the date of communication of this order.
7. The representation of the respondent no. 4 before the said authorities shall be decided by the authority concerned being the respondent no. 3 herein, in accordance with law and as to his legal status, to appear for such hearing.
8. Finally, the representation shall be heard and
disposed of in accordance with law by passing a reasoned order within the period as directed.
9. The respondent no. 3 shall first take a decision regarding the admissibility of the participation of the respondent no. 4 in such proceedings as directed.
10. As no affidavits have been called for, the allegations in the writ application if any, is not admitted.
11. Writ application stands disposed of.

12. Applications, if any, connected thereto stand
disposed of consequently.
13. Interim order, if any, stands vacated.
14. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
