Present criminal revision petition has been filed under Section 401 of the Code of Criminal Procedure 1973 seeking quashing of order dated 10.12.2025 passed by Additional Sessions Judge-I Sri Muktsar Sahib vide which it has been ordered to frame the charges under Sections 420, 465, 467, 468, 471, and 120-B of IPC and Section 13 of Prevention of Corruption Act against the petitioner and non- petitioners (co-accused) on the basis of which order, the charges were framed on 10.12.2025 under the above-said Sections. 2. Learned counsel for petitioner reads out order dated 10.12.2025, whereby the fact from the challan has been noticed that petitioner, qua whom no sanction is obtained by the prosecution agency is not dealt with as a public servant, whereas on the contrary to it, while framing charge-sheet and in the end it has been recorded as under: REENA 2026.07.24 12:51 I attest to the accuracy and integrity of this document Chandigarh CRR-1106-2026 (O&M) “Lastly on the same date time and place, you all the above named accused being a public servant working under MGNREGA, prepared forged document and open the bank accounts on the name of family members and relative of yu accused Amritpal Singh and transferred the amount of Rs. 2,59,000/- of government funds and misappropriate the same by doing the said act you all the above named accused committed all above named accused criminal misconduct and thereby you committed an offence punishable under Section 13 of Prevention of Corruption (Amended Act) 2018 within the cognizance of this Court. And I hereby direct that you be tried by this Court on the above said charge.” 3. The petition is disposed of with the observation that this aspect would be pointed out by the petitioner to the Court below, and if trial Court find that there is some ambiguity in both the orders, i.e. challan/final report and charge-sheet, same may be corrected, otherwise trial Court can proceed as per the law. 4.
